At Nijol Creative, we value client satisfaction and strive to deliver exceptional photography, videography, and related services. This Refund Policy aims to outline the terms under which refunds, rescheduling, and dissatisfaction are addressed. By booking our services, clients agree to the following policies:
1. Non-Refundable Deposits
- A non-refundable deposit of 50% of the total service fee is required to secure the booking. This deposit is necessary to allocate resources and block the date for your project.
- In case of a cancellation initiated by the client, this deposit will not be refunded under any circumstances.
- For all commercial photography projects, a 50% advance payment is required at the time of the shot and is non-refundable.
- The remaining 50% payment must be made upon delivery of the final project, and no refunds will be issued after the completion and delivery of the work.
2. Full Payment Refunds
i) Client-Initiated Cancellations:
- If cancellation occurs 30 days or more before the event, any payments made beyond the non-refundable deposit will be refunded.
- Cancellations made within 30 days of the scheduled service date will result in forfeiture of all payments made, as resources and schedules have already been committed.
ii) Company-Initiated Cancellations:
- If Nijol Creative cancels the service due to unforeseen circumstances or internal issues, clients will receive a full refund, including the non-refundable deposit.
3. Refunds for Dissatisfaction
- If the delivered services or products do not meet the agreed-upon standards, the client must notify Nijol Creative in writing within 7 days of receiving the deliverables.
- Nijol Creative will first offer redress options, including re-edits, reprints, or adjustments to videos/photos at no additional cost.
- Refunds for dissatisfaction will only be considered if:
- The services delivered deviate significantly from the agreed terms or expectations.
- No feasible redress solution is available.
- Refund requests are made within 10 business days of receiving the final deliverables.
4. Refunds for Product Issues
For tangible products like printed photographs, albums, or photo books:
- Refunds or reprints will be provided only in cases of product defects (e.g., poor print quality, or physical damage during delivery).
- Clients must report such issues within 5 days of receiving the product.
- Refunds are not applicable if the client fails to pick up the product within the agreed-upon timeline.
5. Force Majeure Policy
Nijol Creative will not be held liable for cancellations, delays, or rescheduling due to unforeseen circumstances, including but not limited to:
- Natural disasters
- Government restrictions (e.g., lockdowns, curfews)
- Strikes or industrial actions
- Equipment failure or data corruption outside of reasonable control
In such cases, refunds will not apply, but Nijol Creative will work with clients to reschedule services at no additional cost.
6. Expedited Deliverables Refunds
If expedited delivery is paid for and Nijol Creative fails to meet the agreed-upon timeline, the additional expedited charges will be refunded. The standard delivery timeframe will then apply.
7. Refunds for Additional Services
- For extra services (e.g., extended hours, additional photo sessions), refunds are only possible if the service was not provided due to an error on Nijol Creative’s part.
- If the client requests these services but later decides not to use them, no refund will be issued.
- Clients will be informed of the additional charges before the extra hours begin, and these charges will be included in the final invoice with no option for refunds.
8. Rescheduling and Refunds
- Clients may reschedule their booking at least 14 days before the original service date.
- No refund is applicable if rescheduling occurs within 14 days of the service, but the rescheduled date will be subject to Nijol Creative’s availability.
- If Nijol Creative cannot accommodate the rescheduled date, clients may opt for a refund, excluding the non-refundable deposit.
9. Refunds for Third-Party Issues
- Nijol Creative occasionally collaborates with third-party vendors (e.g., decorators, venue providers, and external videographers).
- Refunds will not be provided for dissatisfaction with third-party services. Any disputes with these vendors must be addressed directly with them.
10. Timeline for Refund Processing
- Refund requests will be processed within 15 business days of approval.
- Refunds will be issued via the same payment method used by the client or as mutually agreed upon.
11. Exceptions to Refunds
Refunds are not applicable in the following scenarios:
- Change of Mind: If the client decides to cancel the booking for personal reasons not related to Nijol Creative’s performance.
- Late Arrival: If delays caused by the client result in reduced service time.
- Uncooperative Behavior: If a client’s conduct prevents Nijol Creative from delivering services (e.g., failure to adhere to agreed schedules or provide required access).
- If no samples or references are provided, Nijol Creative will use its professional judgment and creativity to complete the project. Refunds will not be issued based on dissatisfaction with the creative outcome if no guidance or references were provided by the client.
- Nijol Creative is not liable for any data loss or interruptions caused by protocol breaches related to government or presidential issues. Refunds will not be provided for any disruptions or incomplete projects resulting from such circumstances.
- If the client fails to provide the necessary permissions, Nijol Creative reserves the right to cancel the project, and any advance payments made will be non-refundable.
12. Governing Law and Jurisdiction
This Refund Policy is governed by the laws of the People’s Republic of Bangladesh. Any disputes arising from this policy will be resolved under the exclusive jurisdiction of the courts of Bangladesh.
13. Client Acknowledgment
By booking services with Nijol Creative, clients acknowledge and agree to this Refund Policy in full. It is the client’s responsibility to thoroughly read and understand the terms before confirming a booking.
