1. Agreement Overview
This agreement is between Nijol Creative (“the Company”) and the client (“the Client”) for photography, videography, and related services. By booking services with the Company, the Client agrees to the following terms and conditions.

3. Booking and Payment
- A non-refundable deposit of 50% of the total service fee is required to secure the booking.
- The remaining balance must be paid on the day of the event or session.
- An additional 50% of the total bill for events outside Dhaka will be added.
- An additional 50% of the total bill will be added for Hindu weddings.
- For commercial Photography Nijol Creative strictly adheres to the company’s guidelines and regulations for all commercial photography projects. A 50% payment is required at the time of the shoot. The remaining 50% payment must be made upon delivery of the final project.
4. Additional Hours or shots
- Each extra hour of our photographers/videographers/cinematographers will be charged at Tk. 5,000 per hour.
- Each extra hour of Abu Sufian Nilove will be charged at Tk. 10,000 per hour.
- Need to mention, if the project requires additional hours beyond the agreed timeframe, the hourly rate for the extra hours will be determined by Nijol Creative at its discretion.
- Nijol Creative provides photography and videography services separately, and both cannot be performed simultaneously under a single package.
- If clients wish to include photography as an add-on to a videography package, it will incur an additional fee, which will be communicated in advance.
- Nijol Creative will not be held liable for any damage or loss of the primary shot due to unforeseen circumstances or operational challenges during the extra shoot.
5. Delivery of Materials
- Soft copies will be delivered within approximately 5 working days, provided full payment has been cleared.
- Clients are responsible for selecting the pictures to be printed and collecting the photos.
- Once pictures are chosen, it takes approximately 4 weeks to deliver the exclusively edited and printed pictures, and 6-8 weeks to deliver the final video.
- For expedited delivery before 4 weeks, an additional charge of Tk. 10,000 per event applies.
6. Data Collection and Storage
- All outstanding payments must be cleared, and all soft copies must be collected within 7 working days.
- All edited and printed copies must be collected within 3 months. After 3 months, Nijol Creative will not be responsible for any data loss.
7. Image Usage Rights
- Nijol Creative reserves the right to use images and videos for promotional purposes, including portfolios, websites, and social media.
- If the Client does not allow sharing of their images as a portfolio, they must pay an extra 50% of the original package price.
8. Client Responsibilities
- Clients must provide accurate information regarding event details, locations, and timelines.
- Clients are responsible for obtaining any necessary permissions or permits for specific locations.
- Clients must ensure the availability of individuals to be photographed at scheduled times.
- For B2B or B2C industrial photography projects, Nijol Creative will focus solely on delivering the agreed-upon work and will not act as a liaison or communicator on behalf of the client.
- However, if required, Nijol Creative may assist in hiring or appointing a project manager to coordinate and oversee the process, subject to additional charges or agreements.
9. Layout and Inspiration
- For commercial photography projects, clients are encouraged to provide samples, references, or inspiration layouts to help Nijol Creative align with their vision and expectations.
- If no samples or references are provided, Nijol Creative will use its professional judgment and creativity to deliver the project as per industry standards. There is little chance of denying if you do not provide samples.
10. Studio Rental
- Studio rental includes access to specified equipment and facilities as detailed on our website.
- Clients are responsible for any damage to equipment or facilities during the rental period.
- A maximum of 10 people are allowed in the studio at a time.
11. Cancellation and Refunds
- Cancellations made more than 30 days before the scheduled service will receive a full refund of any payments made, excluding the non-refundable deposit.
- Cancellations made within 30 days of the scheduled service will forfeit all payments made.
- In the unlikely event that Nijol Creative must cancel the service, a full refund, including the deposit, will be provided.
12. Limitation of Liability
- Nijol Creative will take all reasonable steps to provide high-quality services. However, in the unlikely event of equipment failure, data loss, or other unforeseen issues, the Company’s liability is limited to refunding payments received.
- Nijol Creative is not liable for any injuries, losses, or damages to persons or property during the provision of services.
13. Drone/Aerial Photography or Documentary
- For drone or aerial shots, it is the client’s responsibility to obtain all necessary permissions from the relevant authorities before the shoot. Nijol Creative will not be held liable for any legal or regulatory issues arising from the use of drones.
- If any issues occur due to insufficient permissions, the client will be responsible for covering any damages or penalties incurred.
- For documentary projects, the client must ensure that all required permissions and permits are issued before Nijol Creative proceeds with the shoot.
14. Content Removal
In the future, if clients request Nijol Creative to remove any posts, images, or media shared by us for logical reasons, we will humbly consider the request and remove it if it is within our control and technically possible.
15. Private or Restricted Work
Clients must mention any private or restricted work requirements before the project begins. Nijol Creative will follow all specified instructions regarding confidentiality and privacy.
16. Compliance with Government and National Regulations
Nijol Creative strictly adheres to all applicable government or national regulations. If any government-related or national issues arise, we will comply with the official rules and directives.
17. Mandatory Written Contract
A written contract is mandatory for all services provided by Nijol Creative. This agreement can be exchanged via email or WhatsApp and will serve as the official record of the project terms.
18. Protocol Breach and Data Loss Liability
In the event of any protocol breach involving government or presidential issues, Nijol Creative will not be liable for any data loss or interruptions caused by such circumstances.
19. Restricted Area Photography
In restricted or sensitive areas, Nijol Creative will only proceed with photography or videography after receiving written permission from the client. Without explicit authorization, no work will be carried out in such areas.
20. Confidentiality
- Nijol Creative will maintain the confidentiality of all private materials and will not disclose or distribute such materials without prior consent from the Client, except where necessary for the delivery of the agreed-upon services or as required by law.
- Clients must also agree to respect the confidentiality of any proprietary information or methodologies used by Nijol Creative.
21. Force Majeure
- Nijol Creative will not be held liable for any delay or failure to provide services due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, strikes, pandemics, or other unforeseeable events.
- In such cases, the Company will make reasonable efforts to reschedule services or provide alternative solutions.
22. Complaints and Dispute Resolution
- If the Client has any complaints about the services provided, they must notify Nijol Creative in writing within 7 days of receiving the deliverables.
- Nijol Creative will work to address any issues promptly and to the satisfaction of the Client.
- If a dispute arises that cannot be resolved amicably, both parties agree to attempt mediation before pursuing legal remedies.
23. Third-Party Services
- Nijol Creative may engage third-party vendors for certain aspects of the services, such as event decorations, additional equipment rentals, or specialized editing.
- While the Company will take reasonable steps to ensure quality, Nijol Creative is not responsible for the performance of third-party vendors.
- Clients may also choose to hire their vendors, but Nijol Creative will not be held liable for any issues arising from external parties.
24. Use of Personal Information
- Nijol Creative collects and stores personal information provided by Clients, such as contact details and event specifics, solely to deliver services.
- Personal information will not be shared with third parties unless required for service delivery or compliance with legal obligations.
- Clients have the right to request access to, correction of, or deletion of their personal information.
25. Intellectual Property Rights
- All images, videos, and creative content produced by Nijol Creative remain the intellectual property of the Company unless otherwise agreed upon in writing.
- Clients are granted a non-exclusive, non-transferable license to use the delivered content for personal or commercial purposes as agreed upon at the time of booking.
- Any unauthorized reproduction, alteration, or resale of Nijol Creative’s work is strictly prohibited.
26. NOC (No Objection Certificate)
- Nijol Creative ensures that a No Objection Certificate (NOC) is obtained from the models featured in commercial photography projects.
- It is the client’s responsibility to ensure that the models also provide a separate NOC, as required.
- In cases where a model does not directly provide an NOC to Nijol Creative, it will be deemed that the model has implicitly agreed to the terms of the NOC through their participation in the project and has no objections to the use of their images or footage as per the agreed terms.
27. Customization and Special Requests
- Nijol Creative is happy to accommodate special requests or customizations to its services whenever possible. All such requests must be discussed and agreed upon in writing before the commencement of services.
- Additional fees may apply for any special requests or customizations.
28. Choreography Requests
Nijol Creative does not provide choreography services for food or product photography. It is the client’s responsibility to hire a choreographer or arrange for the creative setup required for the shoot. Nijol Creative will focus solely on capturing high-quality images as per the agreed scope.
29. Client-Supplied Materials
- If the Client provides props, decorations, or other materials for use during the service, Nijol Creative assumes no responsibility for damage or loss of these items.
- Clients must ensure that all such materials comply with safety standards and are suitable for the intended purpose.
30. Session Timing and Punctuality
- Timely arrival at agreed-upon locations is essential for the smooth execution of services. Delays caused by the Client may result in reduced service time without a refund or additional charges for extended sessions.
- Nijol Creative reserves the right to refuse service if the Client fails to adhere to agreed schedules.
31. Refund Policy for Dissatisfaction
- If the Client is dissatisfied with the quality of services provided, Nijol Creative will review the concerns and may offer re-edits or alternate resolutions at its discretion.
- Refunds will not be provided for dissatisfaction unless it is determined that the services delivered fell significantly short of the agreed-upon standards.
32. Promotional Discounts and Offers
- Nijol Creative occasionally provides promotional discounts or offers. These are valid only for the specified time frame and cannot be combined with other discounts unless explicitly stated.
- Discounts or offers cannot be applied retroactively to previously booked services.
33. Post-Service Communication
- Nijol Creative may contact the Client post-service for feedback, reviews, or testimonials. Such communication is optional, and Clients can opt out at any time.
- Feedback provided may be used for promotional purposes with prior consent from the Client.
34. Governing Law
These terms and conditions are governed by the laws of the People’s Republic of Bangladesh. The courts of Bangladesh have exclusive jurisdiction over any courts of Bangladesh have exclusive.
35. Amendments
Nijol Creative reserves the right to amend these terms and conditions at any time. Clients will be notified of any changes before their booking.
36. Acceptance of Terms
By booking services with Nijol Creative, the Client acknowledges that they have read, understood, and agree to be bound by these terms and conditions. Any failure to adhere to these terms may result in the termination of services without a refund.
37. Entire Agreement
- This document constitutes the entire agreement between Nijol Creative and the Client, superseding any prior agreements, understandings, or communications.
- Any amendments to these terms must be made in writing and signed by both parties.
